These Driver Partner Terms and Conditions ("Driver Terms") constitute a legally binding agreement between you ("Driver Partner", "you") and BharatGati Logistics ("Company", "we", "us", "our"). By registering as a Driver Partner on our Platform and accepting delivery assignments, you confirm that you have read, understood, and agree to be bound by these Driver Terms, along with our general Terms of Service and Privacy Policy.
1. Nature of Relationship
You are an independent contractor, not an employee, agent, or partner of BharatGati. Nothing in these Driver Terms creates an employer-employee relationship, partnership, agency, franchise, or joint venture between you and BharatGati. You are free to accept or decline delivery assignments at your discretion. BharatGati does not guarantee a minimum number of assignments or earnings.
As an independent contractor, you are solely responsible for:
- Payment of all applicable taxes on your earnings (including income tax and GST, where applicable)
- Maintaining valid vehicle insurance, registration, and roadworthiness
- Compliance with all traffic laws and road safety regulations
- Your own health and accident insurance coverage
2. Eligibility & Registration
To register as a Driver Partner on BharatGati, you must:
- Be at least 18 years of age
- Hold a valid driving licence appropriate for the vehicle category you wish to operate
- Own or have authorised use of a vehicle registered in your name or your immediate family member's name
- Reside in Jaipur, Rajasthan
- Have a valid Aadhaar card and PAN card for identity and tax purposes
- Have an active Indian bank account for earnings payouts
- Have no criminal record involving theft, fraud, violence, or sexual offences
We reserve the right to reject any registration application at our sole discretion without assigning a reason.
3. KYC & Document Verification
You must complete KYC (Know Your Customer) verification before you can accept delivery assignments. Required documents include:
- Aadhaar card (front and back)
- PAN card
- Valid driving licence
- Vehicle registration certificate (RC)
- Vehicle insurance certificate (valid and current)
- Vehicle pollution under control (PUC) certificate
- Profile photograph (clear, recent, passport-style)
- Bank account details (account number and IFSC code)
You are responsible for ensuring all documents remain valid and up-to-date throughout your time as a Driver Partner. Expired documents must be renewed and re-uploaded immediately. Failure to maintain valid documents may result in temporary suspension of your account.
BharatGati may engage authorised third-party vendors to conduct background verification checks, which may include checking driving history and criminal records to the extent permitted by applicable law.
4. Vehicle Standards
Your vehicle must at all times:
- Be registered and roadworthy as per applicable Motor Vehicles Act requirements
- Be covered by a valid commercial vehicle insurance policy
- Have a valid PUC certificate
- Be clean, well-maintained, and fit to carry goods safely
- Not have any modifications that are illegal or that render it unsafe for goods transport
You must not use the vehicle for any purpose other than that declared on the registration certificate. BharatGati may, at its discretion, carry out periodic vehicle condition checks.
5. Accepting & Completing Assignments
- You will receive delivery assignment notifications through the BharatGati Driver app. You may accept or decline any assignment.
- Once you accept an assignment, you must proceed to the pickup location promptly and complete the delivery as instructed by the Platform.
- You must comply with any OTP or confirmation requirements at pickup and delivery.
- You must handle all goods entrusted to you with due care and deliver them in the same condition as received.
- You must not open, tamper with, or inspect the contents of any consignment beyond what is necessary for safe transport.
- You must not accept consignments that appear to contain illegal, hazardous, or restricted items. Refer to the Restricted Items list in our general Terms of Service. If in doubt, decline the assignment and report to BharatGati support.
- You are solely responsible for ensuring the consignee receives the delivery. In case of failed delivery, you must follow the instructions provided in the Driver app.
6. Conduct & Standards
As a representative of BharatGati in the field, you are expected to:
- Behave professionally and courteously toward customers at all times
- Not use abusive, threatening, or offensive language
- Not demand additional payment beyond the fare displayed in the app
- Not cancel accepted assignments without genuine reason
- Not engage in fraudulent trip manipulation (e.g., accepting and immediately cancelling to inflate cancellation fees)
- Not solicit customers to transact outside the Platform
- Wear clean, presentable clothing while on duty
- Not drive under the influence of alcohol or any controlled substance
BharatGati maintains a zero tolerance policy for harassment, discrimination, or abuse of customers. Any such behaviour will result in immediate and permanent deactivation of your account.
7. Location & Data
You consent to BharatGati collecting your real-time GPS location data when the Driver app is active. This data is used to:
- Match you with nearby delivery assignments
- Enable customers to track their delivery in real time
- Verify trip routes for accurate fare calculation
- Investigate disputes and ensure platform integrity
Location data collected during a trip is linked to the associated customer's booking record. Refer to our Privacy Policy for full details on how your data is handled.
8. Earnings & Payouts
- You will earn the fare as calculated by the Platform for each completed delivery, minus any applicable platform commission or fees, which will be clearly communicated to you.
- Earnings are credited to your in-app wallet and can be transferred to your registered bank account.
- Minimum payout amount and processing timelines will be as specified in the Driver app.
- BharatGati reserves the right to withhold payouts pending resolution of any active dispute, investigation, or outstanding dues.
- BharatGati may deduct amounts from your wallet for any amounts owed to the Company, including cancellation penalties or chargebacks.
9. Referral Programme
BharatGati may offer a referral programme allowing Driver Partners to earn bonuses by referring new Driver Partners. If you participate in the referral programme:
- Referral bonuses are subject to the referred Driver Partner completing a minimum number of trips as specified in the offer terms.
- Fraudulent referrals (e.g., self-referrals, fake registrations) will result in forfeiture of all referral earnings and account deactivation.
- With your consent, BharatGati may access your contact list solely to facilitate referral sharing. This data will not be shared with any third party.
Referral programme terms may change from time to time. Continued participation constitutes acceptance of updated terms.
10. Ratings & Performance
- Customers may rate your service after each delivery. Your aggregate rating is visible to customers and affects how frequently you are matched with assignments.
- A rating below 3.0 on a 5-point scale may trigger a performance review and potential account suspension.
- Consistently low ratings, high cancellation rates, or repeated complaints may result in permanent deactivation.
- You may dispute a rating you believe is unfair by contacting BharatGati support within 48 hours of the trip.
11. Account Deactivation
BharatGati may temporarily suspend or permanently deactivate your Driver Partner account for reasons including but not limited to:
- Providing false or fraudulent information during registration or KYC
- Allowing an unauthorised person to use your account or vehicle for deliveries
- Transporting restricted or illegal items
- Abusive, threatening, or harassing behaviour toward customers or staff
- Fraudulent trip manipulation or earning abuse
- Expiry of required documents without timely renewal
- Repeated low ratings or high cancellation rates
- Violation of these Driver Terms, the general Terms of Service, or applicable law
In cases of serious misconduct (including safety violations), deactivation may be immediate and without prior notice. For other violations, we will endeavour to provide notice and an opportunity to rectify the issue before permanent deactivation.
12. Indemnification
You agree to indemnify, defend, and hold harmless BharatGati and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, penalties, or expenses (including reasonable legal fees) arising from:
- Your breach of these Driver Terms or applicable law
- Your negligence or wilful misconduct in performing delivery services
- Damage to or loss of goods resulting from your actions or omissions
- Any traffic violations, accidents, or third-party claims arising from your driving
- Mis-declaration of goods handed to you by customers that results in regulatory action
13. Lien on Goods
In the event a consignment cannot be delivered and the customer is unreachable for more than 48 hours, BharatGati (acting through you as its agent) reserves the right to retain the goods until all outstanding dues are settled. If the goods remain unclaimed for more than 7 days, BharatGati may arrange for disposal of the goods to recover costs incurred.
14. Limitation of Liability
BharatGati's liability to you as a Driver Partner is limited to the amounts actually owed to you for completed and verified deliveries. BharatGati shall not be liable for any loss of earnings resulting from Platform downtime, changes to assignment allocation algorithms, or market conditions. BharatGati shall not be liable for any indirect, consequential, or exemplary damages.
15. Governing Law & Dispute Resolution
These Driver Terms are governed by the laws of India. Disputes shall first be attempted to be resolved amicably within 30 days. Unresolved disputes shall be subject to the exclusive jurisdiction of competent courts in Jaipur, Rajasthan.

Grievances will be acknowledged within 24 hours and resolved within 30 days of receipt.
17. Modifications
We may update these Driver Terms from time to time. Updated terms will be published on the Platform with a revised "Last Updated" date. Continued use of the Driver app after posting of changes constitutes your acceptance of the revised Driver Terms.
