Terms of Service

Read the BharatGati Terms of Service — governing your use of our intra-city goods delivery platform in Jaipur, Rajasthan.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "User", "you") and BharatGati Logistics ("Company", "we", "us", "our"), governing your access to and use of our website at bharatgati.com and our mobile application (collectively, the "Platform").

By registering, accessing, or using our Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform immediately.

1. About BharatGati

BharatGati is an intra-city goods transportation platform that connects Customers with independent Driver Partners for on-demand delivery of goods within Jaipur, Rajasthan. BharatGati acts as a technology intermediary — we do not own the vehicles and Driver Partners are independent contractors, not employees of BharatGati.

2. Eligibility

  • You must be at least 18 years of age to register and use our Platform.
  • You must provide accurate, complete, and up-to-date personal information during registration.
  • You must have the legal authority to enter into a binding agreement under Indian law.
  • Use of the Platform for commercial purposes on behalf of an entity is permitted, provided you have authority to bind that entity to these Terms.

We reserve the right to suspend or terminate accounts where eligibility requirements are not met or where false information has been provided.

3. Our Services

BharatGati currently provides the following service:

  • Transportation of Goods by Road: Point-to-point intra-city delivery of goods within Jaipur using two-wheelers, three-wheelers, and four-wheelers (including mini trucks and tempos), facilitated through our Platform.

We may introduce new services, modify existing services, or discontinue any service at our sole discretion. We will endeavour to provide reasonable advance notice of material changes that affect your use of the Platform.

4. Booking & Confirmation

  • An estimated fare is displayed to you before you confirm a booking. By confirming the booking, you accept the applicable fare and these Terms.
  • The final fare may vary from the estimate based on actual distance travelled, waiting time, additional stops, and any applicable surge pricing, which will be reflected in your final invoice.
  • An OTP-based verification may be required at pickup and/or delivery to confirm completion of the service.
  • You are responsible for providing accurate pickup and delivery addresses. BharatGati and Driver Partners shall not be liable for failed deliveries resulting from incorrect address information.
  • You must accurately describe the nature, quantity, weight, and dimensions of the goods at the time of booking. This description constitutes your goods forwarding declaration and is binding on you.
  • No commitment is made for time-bound completion of service. Any estimated time of arrival is indicative only, and delays may occur due to traffic, weather, or circumstances outside our control. BharatGati shall not be liable for losses arising from such delays.

5. Packaging Instructions

Proper packaging is the Customer's responsibility. We recommend the following:

  • Cover goods completely and secure with strong packing tape.
  • Wrap fragile items in bubble wrap, ensuring corners and edges are protected.
  • Fill empty space in boxes with crumpled paper or cushioning material to prevent shifting.
  • Do not use string in place of tape for sealing.
  • Use stretch wrap for items that may shift during transit.

Transportation of fragile or high-value items is at the Customer's own risk. BharatGati shall not be liable for damage to goods resulting from inadequate packaging by the Customer.

6. Restricted Items

You must not use our Platform to transport any of the following:

  • Illegal substances, narcotics, or contraband of any kind
  • Explosives, firearms, ammunition, or weapons
  • Hazardous chemicals, flammable liquids, or radioactive materials
  • Human remains or body parts
  • Live animals (except in appropriate, secure carriers as permitted by law)
  • Cash exceeding ₹50,000 in value
  • Goods that infringe any intellectual property rights
  • Any item whose transportation is prohibited under applicable Indian law

If a consignment is found to contain restricted items, BharatGati reserves the right to refuse or abandon the service immediately without refund, and may report the matter to the relevant authorities. The Customer shall bear full legal and financial liability for any consequences arising from mis-declaration or transportation of restricted items.

7. Fares, Payments & Invoicing

  • Fares are calculated based on distance, vehicle type, waiting time, and any applicable surge or additional charges.
  • Accepted payment methods include: Cash, Online Payment (via integrated payment gateway), and BharatGati Wallet balance.
  • A GST-compliant invoice or bill of supply will be generated upon completion of each delivery.
  • For registered GST entities, the applicable tax treatment (including Reverse Charge Mechanism, where applicable) shall be as per the Central Goods and Services Tax Act, 2017.
  • Any discrepancy in invoice value must be reported to us within 7 days of trip completion. Requests beyond this period may not be processed.
  • BharatGati Wallet top-ups are non-refundable except as wallet credit. Wallet balances may not be transferred or redeemed for cash.

Cash Payments

If you have selected cash as your payment method, the full fare displayed on the Platform at trip completion must be paid to the Driver Partner. Payment made to the Driver Partner is deemed received on behalf of BharatGati. In cases of non-payment or underpayment, BharatGati reserves the right to adjust amounts from your wallet, suspend your account, or initiate recovery proceedings.

8. Cancellation Policy

  • Before Driver Assignment: You may cancel a booking at no charge before a Driver Partner has been assigned.
  • After Driver Assignment: A cancellation fee may apply once a Driver Partner has accepted your booking. The applicable fee, if any, will be displayed to you at the time of cancellation.
  • Auto-Cancellation: If no Driver Partner accepts your booking within the system timeout period, the booking will be automatically cancelled with no charge to you.

Repeated cancellations or no-shows may result in temporary or permanent restrictions on your account.

9. Claims for Loss or Damage

  • Any claim for damage to or loss of goods during transit must be submitted in writing to support@bharatgati.com within 24 hours of delivery.
  • Claims must be accompanied by photographs of the damaged goods and packaging, along with a description of the damage.
  • BharatGati's liability for loss or damage directly attributable to us or our Driver Partners is limited to ten times (10x) the freight amount paid, provided this does not exceed the declared value of the goods.
  • BharatGati shall not be liable for any indirect, consequential, or incidental loss, including loss of income or business arising from delayed, damaged, or lost consignments.
  • For goods exceeding ₹5,000 in declared value, we strongly recommend obtaining independent transit insurance at your own cost.
  • Eligible refunds will be processed within 7–10 working days from the date of claim acceptance, subject to submission of complete documentation.

10. Driver Partners

Driver Partners on the BharatGati Platform are independent contractors and not employees, agents, or representatives of BharatGati. BharatGati does not control the manner in which Driver Partners carry out deliveries, beyond the standards set in the Driver Partner Terms & Conditions. BharatGati shall not be vicariously liable for the acts or omissions of Driver Partners, except to the extent expressly provided in these Terms.

11. User Obligations

By using the Platform, you agree to:

  • Provide accurate and truthful information at all times
  • Use the Platform only for lawful purposes
  • Not misuse, reverse-engineer, or attempt to circumvent any security measure on the Platform
  • Not engage in fraudulent bookings, false damage claims, or abuse of refund/wallet systems
  • Treat Driver Partners with respect and courtesy
  • Ensure goods are properly packaged and correctly declared before handover
  • Comply with all applicable laws, including tax obligations related to your use of the Platform

12. Account Suspension & Termination

BharatGati may suspend or permanently terminate your account, at its sole discretion, for reasons including but not limited to:

  • Providing false or misleading information during registration or booking
  • Attempting to transport restricted items
  • Fraudulent activity, including false damage claims or payment disputes
  • Abusive or threatening behaviour towards Driver Partners or support staff
  • Repeated cancellations or no-shows without cause
  • Violation of these Terms or any applicable law

You may delete your account at any time by contacting us. Account deletion is subject to settlement of any outstanding dues or disputes.

13. Intellectual Property

All content, software, logos, trademarks, and technology on the Platform are the intellectual property of BharatGati or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Platform solely for the purpose of availing our Services. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Platform without prior written consent from BharatGati.

14. Limitation of Liability

To the maximum extent permitted by applicable law, BharatGati's total aggregate liability to you for any claim arising out of or related to the Services shall not exceed the amount of the fare paid for the specific delivery in dispute. BharatGati shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, revenue, data, or goodwill.

15. Modifications to Terms

We may update these Terms from time to time. The revised Terms will be posted on our Platform with an updated "Last Updated" date. Your continued use of the Platform after the posting of changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. In the event of any dispute arising out of or relating to these Terms or the Services, the parties shall first attempt to resolve the matter amicably within 30 days. If not resolved amicably, disputes shall be subject to the exclusive jurisdiction of the competent courts in Jaipur, Rajasthan.
